The often irritating but almost always informative James Reeves, himself an attorney, gives a nice while brief overview of what “stand your ground” really means.
I live in a pretty solid stand your ground state, according to the USCCA….
Indiana is a Castle Doctrine state and has a “stand your ground” law. There is no duty to retreat if deadly force is necessary to prevent serious bodily injury to the person or a third person or the commission of a forcible felony.
Defense of Self or Others
A person is justified in using reasonable force to protect the person or a third person from what the person reasonably believes to be the imminent use of unlawful force. However, a person is justified in using deadly force if the person reasonably believes that that force is necessary to prevent serious bodily injury to the person or a third person or the commission of a forcible felony.
Immunity
No person in this state shall be placed in legal jeopardy of any kind whatsoever for protecting the person or a third person by reasonable means necessary.
That seems pretty cut and dry but as I pointed out in a recent post, There Is No Justice. There Is Just Us., in the case of Ian Cranston he was sentenced to 10 years after being found guilty by a jury that was never told that Cranston had no duty to retreat under Oregon law.
The point of the video is that even though you might be in a “stand your ground” state, it is almost always the best strategy to de-escalate where you can, retreat if doing so doesn’t put you at greater risk and only pulling the trigger if you are left with no other choice.
I assume that few if any of my readers are likely to start blasting at the slightest provocation but it is still a good reminder. The best strategy is still…
A) Avoid crowds.
B) If you can’t do A, then situational awareness is your best line of defense.
C) Be armed in case something still goes wrong.
Putting your fate into the hands of the dimwits that are likely to make up the jury pool in most of the country ought to be a last resort.
I live in a stand-your-ground state. Even then, I’ve the mindset of avoiding lethal force unless ABSOLUTELY necessary. Why?? My lawyer told me long ago, even if everything is perfect, I can expect to pay him over $100K to represent me (if goes to trial). (Other lawyers I’ve spoken to have said similar). The process IS the punishment.
Even if you win, you lose.
Be Remus.
We now live in a Niggers world. Beware
My only “duty” to our bastardized corrupt justice system is the duty to NOT GET FUCKING CAUGHT.
Very vivid reminder of just exactly how dilapidated American law enforcement and courts have become. If you do all kinds of criminality and harm all kinds of folks and its a combination life style/vocation/hobby for you, you’ll rarely if ever be in jail. BUT, if you use lethal force to defend yourself or another person AND you are White, you’ll end up in the penitentiary and your life will be ruined. Makes a ton of effin’ sense. Everything we lose and/or give up all because of nogsan juice.
What you have just described was coined “anarcho-tyranny” by the late Sam Francis, who noted the very same de facto dual system of justice in the U.S. Favored or protected groups can do pretty much as they please without legal consequence, but unprotected identity groups must be the price if they so much as jaywalk. De jure, everyone is subject to the same law, but de facto, there are two sets of laws: One for ordinary unprotected folks, and the ones for the protected classes – which of course includes the ruling class themselves.
All of this sort of makes a mockery of the idea of equal justice under law, but perhaps that is the point.
They couldn’t even make it out of jury duty.
Protect your neck is a God given right.
Evildoers get what they deserve.
I’ve wanted to serve on a jury but my time in law enforcement gets me excluded from criminal cases and my time as an insurance underwriter gets me excluded from civil cases.
My daughter who catches shoplifters at the Mall was telling me on Thanksgiving that the Christmas lighting shooters will be probably looking at some jail time because Concord is not catch and release like Charloot. She says the shoplifting gangs come to the mall not realizing its in Concord and are surprised when they get arrested and aren’t released in a couple of hours.
There are other conclusions that can be made of this situation.
My conceal carry mags are carefully loaded while wearing nitril gloves, just to increase my options.
I would rather be judged by twelve than carried by six, but better yet would be to avoid both situations.
Avoid crowds. Put a pistol near every fire extinguisher.
